  • 1.  ADDITIONAL OR LONGER WASH-UP PERIODS.

    Installation heads shall grant reasonable wash-up time to those employees who perform dirty work or work with toxic materials.

    2.  THE ESTABLISHMENT OF A REGULAR WORK WEEK OF FIVE DAYS WITH EITHER
         FIXED OR ROTATING DAYS OFF.

    Full-time regular employees in the APWU craft shall have a fixed five-day work week.

    3. GUIDELINES FOR THE CURTAILMENT OR TERMINATION OF POSTAL
        OPERATIONS TO CONFORM TO ORDERS OF LOCAL AUTHORITIES OR AS     LOCAL CONDITIONS WARRANT BECAUSE OF EMERGENCY CONDITIONS

    The decision for curtailment or termination of Postal Operations to conform to the orders of local authorities, or as local conditions warrant because of emergency condiitons, shall be made by the installation head. When the decision has been reached to curtail postal operations, to the extent possible, management will notify and seek the cooperation of local radio and television stations to inform employees.

    4.  FORMULATION OF LOCAL LEAVE PROGRAM

    1. The installation head or designee shall meet with representatives of the Union Local 3133 Tucson Area Local to review local service needs as soon after November 15 as practicable.The installation head shall then determine a final date for submission of applications for vacation period(s) as provided for in Article 10 of the National Agreement. Choice vacation shall be awarded as provided for as in Article 10, Section 3.D.1,2,3,4 of the National Agreement and this LMOU. Choice vacation leave is to be granted on a seniority basis. There will be two (2) rounds of choice vacation selections in the Casa Grande office.
    2. Employees will be given two (2) days to make their selection for each round of choice
      vacation periods. If unable to make a selection, the employee will be passed over and put at
      the bottom of the list. The union steward or designee will be responsible for the proper
      procedures of the vacation calendar.
    3. For cancellation of Annual Leave during the choice vacation period: any clerk may request to
      cancel approved Annual Leave in units (weeks/periods) of five (5), ten(10), or fifteen (15)
      days provide a written request is given to the supervisor no less than seven (7) days prior to
      the beginning of the approved Annual Leave period. The written request is a du[plicate PS
      Form 3971.
    4. If an employee forfeits their choice leave during the leave year at least seven (7) days prior to
      the Tuesday preceding the service week for which the leave was requested, that leave unit
      will be posted for three (3) days and then awarded to the senior bidder. The PS Form 3971
      filled out in duplicate will serve as the bid form.

    5.  THE DURATION OF THE CHOICE VACATION PERIOD

    The choice vacation period shall be through and inclusive of both dates from February 1 through
    September 30.

    6.  THE DETERMINATION OF THE BEGINNING DAY OF AN EMPLOYEE'S VACATION
    PERIOD.

    The vacation period shall start of the Saturday of the employee's basic work week. Exceptions
    may be granted by agreement among the employee, his union representative, and the employer.

    7. WHETHER EMPLOYEES AT THEIR OPTION MAY REQUEST TWO SELECTIONS
    DURING THE CHOICE VACATION PERIOD, IN UNITS OF EITHER 5 OR 10 DAYS.

    Employees may request two selections during the choice vacation period in units of five (5) or
    ten (10) days. The total leave approved cannot exceed the number of days authorized in Article 10
    Section 3.D. 1,2, or 3 as appropriate.

    8. WHETHER JURY DUTY AND ATTENDANCE AT NATIONAL OR STATE CONVENTIONS
    SHALL BE CHARGED TO THE CHOICE VACATION PERIOD.

    An employee who is called for jury duty during the employee's scheduled choice vacation priod
    or who attends a National, State or Regional Convention (Assembly) during the choice vacation period is eligible for another available period provided this does not deprive any other employee of
    first choice for scheduled vacation.

    9. DETERMINATION OF THE MAXIMUM NUMBER OF EMPLOYEES WHO SHALL RECEIVE LEAVE EACH WEEK DURING THE CHOICE VACATION PERIOD.

    When requested, a maximum of 12% of the employees will be granted leave in accordance with
    item 4 of this memorandum. The 12% will include extended sick leave, military leave, leave to
    attend conventions, and annual leave. When applying the 12% requirement, any fraction of .50
    or more will be rounded to the next higher number, and any fraction less than .50 will be rounded
    to the next lower number.

    10. THE ISSUANCE OF OFFICIAL NOTICES TO EACH EMPLOYEE OF THE VACATION
    SCHEDULE APPROVED FOR SUCH EMPLOYEE.

    <All applications (PS Form 3971) for annual leave during the choice vacation period shall be
    submitted by January 15th in duplicate. The employee shall receive a signed duplicate copy by
    February 1.

    11. DETERMINATION OF THE DATE AND MEANS OF NOTIFYING EMPLOYEES OF THE BEGINNING OF THE NEW LEAVE YEAR.

    A notice shall be posted by the time clocks no later than November 15 notifying the employees of the beginning of the new leave year.

    12. THE PROCEDURES FOR SUBMISSION OF APPLICATIONS FOR ANNUAL LEAVE DURING OTHER THAN THE CHOICE VACATION PERIOD.

    Requests for incidental annual leave will be submitted on PS Form 3971 in duplicate no earlier than 60 days in advance and no later than the Tuesday prior to the service week in which the annual leave is desired. Approval or denial of the request for annual leave will be given no later than the Tuesday preceding the sevice week for which the leave is requested. Requests shall be considered on a first come first service basis. Requests submitted at the same time will be granted on a seniority basis.

    13. THE METHOD OF SELECTING EMPLOYEES TO WORK ON A HOLIDAY.

    The following will be used for holiday scheduling.

    All casuals and part time employees to the extent possible, even if payment of overtime is required.

    All full time and part time regular employees who possess the necessary skills and have volunteered to work on the holiday or their designated holiday.

    Transitional Employees (TEs) to the extent possible, will be scheduled for work on a holiday or designated holiday after full time volunteers are scheduled to work on their hol;iday or designated holiday.

    Full time and part time regular non-volunteer employees whose scheduled non-work day falls on the holiday and who possess the necessary skills, even though the payment of overtime is required, by juniority.

    Full time and part time regular employees who have not volunteered to work their holiday, by juniority.

    14. WHETHER "OVERTIME DESIRED" LISTS IN ARTICLE 8 SHALL BE BY SECTION AND/OR TOUR

    Overtime desired lists for bargaining unit employuees will be administered by craft, as follows

    Where there are multiple locations within an installagion, separate overtime desired lists should be maintained at each location. (eg. Stations, branches, P & DCs, VMFs, etc.)

    At least two hours of advance notice shall be given, when possible, when overtime is required.

    15. THE NUMBER OF LIGHT DUTY ASSIGNMENTS WITHIN EACH CRAFT OR OCCUPATIONAL GROUP TO BE RESERVED FOR TEMPORARY OR PERMANENT LIGHT DUTY ASSIGNMENT.

    There shall be no official number for temporary or permanent light duty assignment. Each request for temporary light duty assignment shall be adjudicated on its own basis and temporary light duty assignment shall

    16. THE METHOD TO BE USED IN RESERVING LIGHT DUTY ASSIGNMENTS SO THAT NO REGULARLY ASSIGNED MEMBER OF THE REGULAR WORK FORCE WILL BE ADVERSELY AFFECTED.

    Management and the union shall consult on the way and means of establishing light duty assignments in the Casa Grande Post Office, in accordance with Article 13.

    17. THE IDENTIFICATION OF ASSIGNMENTS THAT ARE TO BE CONSIDERED LIGHT DUTY WITHIN EACH CRAFT REPRESENTED IN THE OFFICE.

    The following shall serve as a guide for the Postmaster when assiging employees to light duty:
    1. All light duty applications must be submitted in writing in accordance with Article 13. The Postmaster will consider such applications.

    2. Employees who are approved for light duty will be assigned to operations where work exists within their physical limitations. First consideration will be given to modifying he employee's regular work assignment.


    18. THE IDENTIFICATION OF ASSIGNMENTS COMPRISING A SECTION, WHEN IT IS PROPOSED TO REASSIGN WITHIN AN INSTALLATION, EMPLOYEES EXCESS TO THE NEEDS OF A SECTION.

    For the purposes of applying Article 12 of the National Agreement, the entire installation shall be considered a section.

    19. THE ASSIGNMENT OF EMPLOYEE PARKING SPACES

    Parking spaces in excess of USPS needs will be available on a first come first served basis.

    20. THE DETERMINATION AS TO WHETHER ANNUAL LEAVE TO ATTEND UNION ACTIVITIES REQUESTED PRIOR TO DETERMINATION OF THE CHOICE VACATION SCHEDULE IS TO BE PART OF THE TOTAL CHOICE VACATION PLAN.

    Annual leave approved to attend union activies prior to the granting of choice vacation period will be counted in the percentage provided for in item 9 of this memorandum.


    21. THOSE OTHER ITEMS WHICH ARE SUBJECT TO LOCAL NEGOATIATIONS A PROVIDED IN THE CRAFT PROVISIONS OF THIS AGREEMENT.

    Labor-Management meetings between a representative of the employer and the union shall be held at a minimum of once per quarter. It is agreed that items for discussion at the meeting shall be exchanged by the parties to this agreement five (5) days prior to such meetings. Non-agenda items may be discussed by mutual consent. With the mutual consent of both parties in writing, a particular meeting may be canceled or changed to another date.


    22. LOCAL IMPLEMENTATION OF THIS AGREEMENT RELATING TO SENIORITY, REASSIGNMENTS AND POSTING.

    Article 37. Section 3.A.4 - Reposting

        4. b. The incumbent shall have the option of accepting changes in duties and principal assignment.

            c. The incumbent shall have the option of accepting a new reporting time in excess of one hour.

    Article 37. Section 3.F.2 - Results of Posting

        2. The successful bidder must be placed in the new assignemnt within 28 days except in the month of December.




    LOCAL MEMORANDUM OF UNDERSTANDING
    CASA GRANDE, ARIZONA
    NOVEMBER 21, 1998-NOVEMBER 20,2000


    This Local Memorandum of Understanding consitutes agreement between the Casa Local 3133 Tucson Area Local of the American Postal Workers Union and the management of the United States Postal Service, Casa Grande, Arizona,

    The Matters set forth herein are entered into pursuant to the Local Implementation Provisions of the 1998-2000 National Agreement and constitute an agreement on matters relating to local implementation. This agreement is entered into pursuant to the terms of Article 30 of the National Agreement on April 15, 1999, between the representtive of the USPS and the designated agent of the American Postal Workers Union, AFL-CIO.

    It is understood between the undersigned parties that this Local Memorandum of Understanding shall neither conflict with the National Agrement, nor deprive an employee of any rights or benefits provided for under the National Agreement. Should understandings set forth in this Memorandum be found to be in conflict with any provision of the National Agreement, such understandings will be considered negated and the provision of the National Agreement shall prevail The terms of this Local Memorandum of Understanding are subject to the grievance procedures as contained in the National Agreement.
